20세기 중반의 영어권 철학에서 정의론은 죽은 분야에 가까웠다. 좋음과 옳음은 취향의 표현일 뿐이라는 분석철학의 기류 속에서, 사회를 어떻게 짜야 하는가라는 큰 질문은 철학의 일이 아니라고 여겨졌다. 롤스의 젊음은 그 질문을 피할 수 없게 만든 시간이었다. 어린 시절 동생 둘이 그에게서 옮은 병으로 잇달아 죽었다 — 디프테리아와 폐렴. 그는 태평양전쟁에 보병으로 참전해 뉴기니와 필리핀을 거쳤고, 히로시마 원폭 직후의 폐허를 지나갔다. 성공회 사제가 되려던 계획은 전쟁을 지나며 무너졌다. 신정론 대신 그는 다른 질문을 붙들었다 — 운은 이렇게 불공평한데, 제도는 무엇을 할 수 있는가.In mid-century anglophone philosophy the theory of justice was close to a dead field: amid the analytic mood that treated good and right as expressions of taste, the large question of how society should be arranged was held to be no business of philosophy. Rawls’ youth made the question unavoidable. Two younger brothers died of diseases caught from him — diphtheria, then pneumonia. He fought as an infantryman in the Pacific, through New Guinea and the Philippines, and passed through the ruins of Hiroshima just after the bomb. His plan to become an Episcopal priest did not survive the war. In place of theodicy he kept a different question: luck is this unfair — what can institutions do about it?

The calculation utilitarianism can permit — taking a minority’s liberty because the total gain is larger — he blocks at the door: each person possesses an inviolability that even the welfare of society as a whole cannot override. That is the book’s first page.

If you had to set society’s rules not knowing which country, which family, which body you would be born into — would you bet on being born rich and choose slavery, or choose a world livable even at the bottom? Blind self-interest to its own position, and self-interest becomes the engine of fairness. It is the old wisdom of cake-cutting — let the one who cuts choose last — scaled up to the constitutional level. From behind the veil, he argues, two principles get chosen: equal basic liberties for all, first; and inequalities only where they benefit the least advantaged (the difference principle), second.

삶이 만든 철학A philosophy made by a life

『정의론』이 나오자 죽었다던 분야가 되살아났다. 정치철학의 거의 모든 논의가 이 책에 대한 찬성이나 반론으로 재편됐고, 가장 강한 반론은 삼 년 뒤 같은 복도에서 나왔다 — 하버드의 동료 노직이 『아나키, 국가, 유토피아』(1974)로 되받은 것이다. 정당하게 번 것을 가장 불리한 사람을 위해 재분배하는 것 자체가 개인의 권리 침해라는 자유지상주의의 반격이다. 롤스 대 노직은 지금도 분배 정의 논쟁의 기본 구도로 남아 있고, 이 아틀라스는 그 승부를 판정하지 않는다. 확정된 것은 논쟁의 지형을 롤스가 다시 그렸다는 사실이다. 왼쪽에서도 반론이 왔다. 베일 뒤의 인간은 너무 추상적이라 공동체와 역사가 지워진다는 공동체주의의 비판, 가족 안의 정의를 다루지 않았다는 페미니즘의 비판. 그는 반론을 피하지 않고 이후 삼십 년 동안 이론을 고쳐 썼다 — 『정치적 자유주의』는 서로 화해할 수 없는 세계관들이 한 사회에서 어떻게 같은 정의 원칙에 합의할 수 있는가라는, 첫 책이 남긴 구멍에 대한 답이다. 사람은 이론과 닮아 있었다. 말을 더듬었고, 각광을 피했고, 강의가 끝나면 학생들의 박수를 등지고 서둘러 나갔다. 명예박사 학위도 대부분 사양했다. 자신의 재능조차 — 그 재능으로 얻은 지위조차 — 도덕적으로 보면 응당한 몫이 아니라 운이라고 쓴 사람이었다. 타고난 것을 자격이 아니라 우연으로 보는 그 시선이, 동생들의 죽음과 히로시마의 폐허에서 시작해 평생을 관통한다.When A Theory of Justice appeared, the field pronounced dead came back to life: nearly every debate in political philosophy reorganised itself as agreement or objection, and the strongest objection came three years later from down the hall — his Harvard colleague Nozick’s Anarchy, State, and Utopia (1974), the libertarian counterstrike holding that redistributing what was justly earned, even for the least advantaged, itself violates individual rights. Rawls versus Nozick remains the basic geometry of the distributive-justice debate, and this atlas does not referee it. What is settled is that Rawls redrew the terrain on which it is fought. Objections came from the left as well: the communitarian charge that the person behind the veil is too abstract — community and history erased — and the feminist charge that justice inside the family went unexamined. He did not dodge; he spent thirty years rewriting. Political Liberalism answers the hole the first book left: how can irreconcilable worldviews within one society agree on the same principles of justice? The man resembled the theory. He stuttered, avoided the spotlight, hurried out of lecture halls with his back to the applause, declined most honorary degrees. He wrote that even one’s talents — even the position those talents earn — are, morally speaking, luck rather than desert. That way of seeing the inborn as accident rather than entitlement runs from his brothers’ deaths and the ruins of Hiroshima through everything he wrote.
